Welcome to TypiTrain. These Terms of Service ('Terms') govern your use of the TypiTrain website and services at typitrain.com, operated by Tobias Wetzel ('we', 'us', or 'Provider').

By accessing or using TypiTrain, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

TypiTrain is a typing practice application that helps users learn and improve their touch-typing skills. Our services include:

• Typing exercises and lessons
• Progress tracking and statistics
• Adaptive learning based on your performance
• Class and organization features for educational use
• Custom exercise creation

You may create an account to save your progress across devices. Registration requires a valid email address.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account and password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the service.

You agree to use TypiTrain only for lawful purposes and in accordance with these Terms. You must not:

• Use the service for any illegal or fraudulent purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Upload malicious code, viruses, or harmful content
• Use automated tools to scrape or copy content without permission
• Impersonate any person or entity
• Collect personal information of other users without consent
• Use the service for commercial purposes without our written consent

We reserve the right to suspend or terminate accounts that violate these Terms.

You may create custom exercises and content within TypiTrain. You retain ownership of content you create, but grant us a license to host and display it as part of the service.

You are responsible for ensuring your content does not violate any laws or third-party rights. We may remove content that violates these Terms.

TypiTrain and its original content, features, and functionality are owned by the Provider and are protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our service without our express written permission.

We grant you a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes.

Teachers and educational institutions may use TypiTrain for classroom purposes. Class features allow teachers to:

• Create and manage classes
• Assign exercises to students
• Monitor student progress

Teachers are responsible for ensuring appropriate use by their students and for complying with applicable educational privacy laws.

TypiTrain is currently offered as a free service. We reserve the right to:

• Modify or discontinue any part of the service at any time
• Introduce paid features in the future
• Display advertisements

We will provide reasonable notice of significant changes where possible.

You may delete your account at any time through the account settings. Upon deletion, your data will be permanently removed.

We may suspend or terminate your account if you violate these Terms. In case of termination for violation, you may lose access to your data without refund.

TypiTrain is provided 'as is' and 'as available' without warranties of any kind, either express or implied.

We do not guarantee that:

• The service will be uninterrupted or error-free
• The results from using the service will be accurate or reliable
• Any errors will be corrected

Your use of the service is at your own risk.

To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the past 12 months (if any).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of these limitations may not apply to you.

TypiTrain uses third-party services for hosting, authentication, and analytics. Your use of these services is subject to their respective terms and privacy policies.

We are not responsible for the content or practices of third-party services.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the 'Last Updated' date.

Your continued use of TypiTrain after changes become effective constitutes acceptance of the new Terms.

If you are a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU).

To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement (e.g., an email to contact[at]typitrain.com) before the 14-day period expires. The withdrawal period begins on the day you complete your purchase.

Upon valid withdrawal, we will reimburse all payments received from you without undue delay, and no later than 14 days from the day we are informed of your withdrawal. We will use the same means of payment used for the original transaction.

Please note: By purchasing and downloading digital content, you may expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal. This consent is requested during the checkout process.

We offer a 30-day money-back guarantee on all purchases of the TypiTrain Desktop App. If you are not satisfied with your purchase for any reason, you may request a full refund within 30 days of the purchase date.

To request a refund, contact us at contact[at]typitrain.com with your order details. Refunds will be processed within 14 business days using the original payment method.

This guarantee is in addition to your statutory rights, including the EU right of withdrawal described above.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law provisions.

For users in the European Union, nothing in these Terms affects your rights under applicable consumer protection laws.

Any disputes arising from these Terms shall be resolved in the competent courts of Vienna, Austria, unless otherwise required by applicable law.
